This activity should have been executed already during the sales phase because this could have a major impact on the engagement costs and the Services Delivery Model. If not, it definitely has to start in the Preparation And Design phase.

In some outsourcing deals the Client pays for the staff take-over and conversion of terms and conditions separately. As this information is highly privacy sensitive, we often do not receive the necessary information to determine the scope of the staff transfer during the sales phase. In case of separate payment there also is less need to receive this information upfront.

Please be aware that it does not matter whether Capgemini would like to take over staff, whether Capgemini could use the staff for service management and/or service delivery, whether the staff prefers to be taken over. This activity is aimed at investigating what staff is in scope of a “staff take-over” obliged by law and the costs related to this take-over.

Local laws are different all over the world. The parties to involve are also different all over the world. This action and tasks might need specific local legal and HR expertise.

All artifacts created in this activity can contain information that might be subject of privacy legislation. These artifacts could therefore have two versions: one version accessible to the HR department only and one version in which the data is made anonymous to be shared across the work streams as needed.
